The Recent Tesla Crash on I-4
Electrek recently reported on a fatal crash involving a Tesla Model 3 on Interstate 4 near Lake Mary Boulevard. The Tesla was reportedly stopped in a travel lane when it was struck by a semi, killing the Tesla driver.
According to the report, data submitted by Tesla to federal regulators indicated that a driver-assistance system was engaged. We don’t know why the car stopped.
What the story does raise is a larger question every driver using this technology should understand:
When your car is helping you drive, who is actually responsible for driving it?
The short answer is that you are, though insurance settlements have also been paid by the car manufacturers when these systems are involved.
Is Autopilot the Same as a Self-Driving Car?
No. Systems currently offered in many vehicles are generally considered driver-assistance or partial-automation systems, not truly autonomous vehicles.
Tesla itself calls its current system Full Self-Driving (Supervised) and says it requires active driver supervision. The National Highway Traffic Safety Administration describes Level 2 automation similarly: the vehicle may handle steering and acceleration or braking, but the human driver must remain engaged and monitor the road.
Florida law separately recognizes truly autonomous vehicles that can operate without a human driver. That is a different legal category from the supervised driver-assistance systems most people have in their personal vehicles today.
Can You Override Autopilot or Driver-Assistance Systems?
Generally, yes.
These systems are designed with the expectation that the human driver can and sometimes must intervene. Exactly how that happens depends on the vehicle and the system.
A driver may need to steer, brake, accelerate or otherwise take control when something unexpected happens.
If your car does something that scares you, don't sit there wondering whether you're supposed to interrupt it. You are the driver. Drive.
Manufacturer warnings recognize this too. Tesla, for example, specifically warns that immediate driver intervention may be necessary in situations such as construction zones, complicated intersections and unusual roadway conditions.
Have There Been Lawsuits Over Autopilot Accidents?
Yes. Florida has already seen a major one.
A federal jury considered a 2019 crash in the Florida Keys involving a Tesla operating with Autopilot engaged. The driver had dropped his phone and looked down to retrieve it before the vehicle traveled through an intersection and struck people beside a parked vehicle. One person was killed and another was seriously injured.
The jury examined the technology and the driver’s conduct and ultimately assigned 67% of the responsibility to the human driver and 33% to Tesla. The judgment against Tesla was approximately $243 million, including punitive damages. Tesla has appealed that judgment.
There have also been confidential settlements in other fatal-crash lawsuits involving driver-assistance technology, including a Florida case involving a Delray Beach driver. Those settlement amounts were confidential.
Is This Just a Tesla Issue?
Not at all. In 2026, the National Transportation Safety Board released findings involving two fatal crashes in vehicles using Ford's BlueCruise partial-automation technology. The NTSB identified driver overreliance on the automated systems as one of the issues contributing to the crashes.
What happens when very capable technology makes a human driver feel more capable than they really are?
Research suggests that driver assistance makes people much more likely to multi-task. The Insurance Institute for Highway Safety has studied drivers using partial-automation systems and found that drivers became more likely to multitask while the technology was operating.
And we all know that multi-tasking often leads to worse than normal performance on all those tasks. So if we have a not-good driver who is multi-tasking after barely passing their driving test, that is a scary scenario.
Even more concerning, drivers can become familiar with how the monitoring system works and learn how much distraction they can get away with before the vehicle starts warning them.
AAA, which is headquartered here in Orlando, found in a 2025 survey that only 13% of U.S. drivers trusted riding in a self-driving vehicle.
About six in ten were afraid to ride in one. Drivers were much more receptive to safety features such as automatic emergency braking and lane-keeping assistance.
Central Florida Is Already Part of the Autonomous-Vehicle Story
Lake Nona introduced autonomous shuttles years ago as part of Central Florida's effort to explore emerging transportation technology. When those shuttles arrived, Orlando firefighters even trained on how to manually control the vehicles in an emergency.
Does Autopilot Get the Ticket, or Does the Driver?
For the supervised driver-assistance systems most consumers are using today, the human driver remains responsible for monitoring and controlling the vehicle.
I have said something similar about blind-spot monitors for years: The sensor doesn't get the ticket. You do.
Today I would expand that advice: Autopilot doesn't have a driver's license. It doesn't worry about getting hurt. And it has absolutely no sense of self-preservation.
How Should Drivers Safely Use Autopilot and Other Driver-Assistance Technology?
Use the technology. Let it help you. But keep your eyes on the road, know what is happening around you and understand what your particular vehicle can and cannot do.
Do not use partial automation as permission to text, hunt for something on the floor, read an email or mentally check out of driving. If something does not look right, intervene.

Multitasking while using partial automation: IIHS found drivers were more likely to use phones, eat, groom or perform other distracting activities when partial automation was engaged. Drivers learning how to work around attention warnings: The same IIHS research found Tesla Autopilot users learned the timing of attention reminders and sometimes continued distracting activities while preventing warnings from escalating.
